Builda LLC (“Builda,” “we,” “us,” or “our”) respects your privacy and is committed to protecting Personal Data.

This Privacy Policy explains how Builda collects, uses, processes, stores, discloses, and otherwise handles Personal Data in connection with Builda’s website at buildastg.kinsta.cloud and Builda’s operating system, applications, artificial intelligence features, software, APIs, integrations, marketplace, payment functionality, communications, and related products, features, and services (collectively, the “Services”).

This Privacy Policy also explains the privacy rights and choices that may be available to you.

Where applicable law requires consent for a particular processing activity, Builda will seek that consent through an appropriate mechanism. Your use of the Services does not constitute consent where applicable law requires a separate form of consent.

Additional terms may apply to certain Customers, products, features, or processing activities under Builda’s Terms of Service, customer agreements, data processing terms, or other agreements.

1. Scope and Builda’s Relationship With You

Builda provides an online operating system through which businesses, organizations, and other users can manage information, people, companies, workflows, communications, projects, transactions, payments, applications, artificial intelligence features, integrations, and other business activities.

Builda’s legal role with respect to Personal Data depends on why and how the information is processed.

Customer Data

Businesses, organizations, and other customers that use the Services (“Customers”) may create, collect, submit, upload, import, synchronize, transmit, receive, store, or otherwise process information through Builda (“Customer Data”).

Customer Data may include information concerning a Customer’s employees, contractors, users, customers, prospective customers, vendors, business contacts, companies, transactions, communications, projects, tasks, files, records, payments, workflows, and other information selected by the Customer.

When Builda processes Personal Data contained in Customer Data solely to provide the Services on behalf of a Customer and in accordance with that Customer’s instructions, the Customer generally determines the purposes and means of processing. In those circumstances, the Customer generally acts as the controller, business, or equivalent entity under applicable privacy law, and Builda generally acts as the processor, service provider, contractor, or equivalent entity.

Customers are responsible for their collection and use of Customer Data, including obtaining any required rights, permissions, legal bases, or consents; providing legally required notices; responding to applicable privacy requests; configuring appropriate permissions; and complying with laws applicable to their Customer Data.

If your Personal Data is contained in an account controlled by a business or organization, requests concerning that Customer Data should generally be directed to that organization or its account administrator.

Personal Data Builda Controls

Builda may independently determine the purposes and means of processing certain Personal Data. For such processing, Builda may act as a controller, business, or equivalent entity.

Personal Data” means information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked directly or indirectly to an identified or identifiable person, household, or device where applicable law treats such information as personal information or personal data.

Personal Data generally does not include information that has been lawfully aggregated, anonymized, or de-identified so that it cannot reasonably be associated with an identifiable individual.

When Customers use Builda to collect money from others, the Customer remains responsible for its own legal obligations relating to those transactions and the Personal Data it collects.

Where required by applicable law, Builda also recognizes qualifying browser-based opt-out preference signals, including Global Privacy Control (“GPC”), for the browser or device transmitting the signal and for other information required by applicable law.

Traditional “Do Not Track” signals are different from legally recognized opt-out preference signals. Because there is no universally accepted standard governing traditional Do Not Track signals, Builda does not respond to them unless applicable law requires otherwise.

Customers and users are responsible for ensuring they have the legal right and authority to connect a third-party service and authorize Builda to access or process information through it.

Builda does not control and is not responsible for the independent privacy, security, or data practices of third-party services.

8. Builda Marketplace and Third-Party Applications

Builda may make third-party applications, integrations, extensions, features, or other functionality available through Builda.

Outside developers may publish applications or functionality on Builda only with Builda’s approval.

Builda’s approval, availability, review, or inclusion of a third-party application does not constitute a guarantee or representation concerning the developer’s privacy practices, security practices, content, conduct, legal compliance, or continued availability.

Third-party applications may request access to information within Builda based on their functionality.

Customers and administrators are responsible for reviewing permissions and determining whether to install or authorize third-party applications.

Where an independent third-party developer receives Personal Data, its handling of that information may be governed by its own privacy practices and agreements.

Builda may restrict, suspend, disable, or remove a third-party application where Builda determines doing so is appropriate for security, privacy, legal, compliance, contractual, operational, or other reasons.

9. Artificial Intelligence and Machine Learning

Builda includes or may include artificial intelligence, machine learning, automated workflows, agents, assistants, recommendations, content-generation functionality, analysis tools, and related technologies (“AI Features”).

Depending on the feature, Customer configuration, permissions, and instructions, AI Features may process:

AI Features may produce content, summaries, classifications, recommendations, analyses, predictions, workflows, communications, actions, or other outputs.

Where authorized, AI Features may perform actions within Builda or interact with connected third-party services.

AI Training and Improvement

Subject to applicable law, applicable Customer agreements, contractual restrictions, settings, permissions, and legally required choices, Builda may use information processed through the Services, including Customer Data, AI inputs and outputs, feedback, and usage information, to develop, train, fine-tune, evaluate, test, secure, maintain, and improve Builda’s artificial intelligence, machine learning, and related systems and Services.

Where applicable law requires consent, an opt-out, or another specific legal basis for such processing, Builda will provide the applicable mechanism or otherwise process the information as required by law.

Builda does not intentionally seek Sensitive Data for generalized AI training. Customers and users must not submit Restricted Data, as defined below, for AI training or AI processing unless Builda expressly supports that processing.

Third-Party AI Providers

Builda may transmit information to third-party artificial intelligence, model, infrastructure, hosting, or other technology providers where necessary or appropriate to operate, support, develop, secure, or improve AI Features.

The information transmitted depends on the feature being used.

Such providers may process information as Builda service providers or, depending on the particular feature or integration, in another capacity permitted by applicable law and applicable agreements.

Customer Responsibility for AI Data

Customers and users are responsible for ensuring that they possess all rights, permissions, notices, consents, and other legal authority required to provide information to AI Features or authorize an AI Feature to access, analyze, use, generate from, disclose, or act upon that information.

Customers may configure Builda functionality for their own automated workflows or decision-making. Customers are responsible for determining whether their use of such functionality is lawful and for providing any notices, rights, safeguards, consent, or human review required by applicable law.

Where Builda itself engages in automated decision-making that is subject to specific notice, access, explanation, or opt-out requirements under applicable law, Builda will provide those rights when legally required.

10. How Builda Uses Personal Data

Builda may process Personal Data to:

Integrations and Applications

Builda may disclose information to a third-party service when a Customer or user connects, enables, installs, authorizes, or directs Builda to interact with that service.

Advertising and Analytics Providers

Builda may disclose device information, identifiers, cookie information, online activity, advertising interactions, conversion information, and related information to advertising and analytics providers as described in this Privacy Policy and subject to applicable privacy choices.

At Your Direction

Builda may disclose information where you or the applicable Customer requests, authorizes, directs, or consents to the disclosure.

Affiliates

Builda may disclose Personal Data to any current or future entities that directly or indirectly control, are controlled by, or are under common control with Builda where reasonably necessary for purposes described in this Privacy Policy.

Business Transactions

Builda may disclose information in connection with an actual, proposed, or potential:

Certain privacy laws may classify disclosures involving advertising cookies, pixels, device identifiers, online activity, or similar information as a “sale,” “sharing,” “targeted advertising,” or another regulated disclosure even if Builda receives no monetary payment.

Where applicable law provides an opt-out right, you may exercise that right through the privacy choices mechanism available on buildastg.kinsta.cloud.

Where required by applicable law, Builda honors qualifying opt-out preference signals, including GPC.

Builda does not knowingly sell or share Personal Data of individuals under 18.

13. Aggregated and De-Identified Information

Builda may create aggregated, anonymized, or de-identified information from information processed through the Services.

Builda may use and disclose such information for lawful purposes, including:

Where applicable law requires de-identified information to remain de-identified, Builda will maintain that information in de-identified form and will not attempt to re-identify it except as permitted by applicable law, including where necessary to evaluate de-identification processes or protect against security threats.

14. Sensitive Data and Restricted Data

Builda is a general-purpose business operating system. Customers determine what information they submit to the Services.

Builda does not undertake a general obligation to inspect, classify, review, or continuously monitor every item of Customer Data to determine whether it contains Sensitive Data, regulated information, confidential information, or information subject to specialized legal requirements.

This does not prevent Builda from accessing or reviewing information where reasonably necessary for security, fraud prevention, support, legal compliance, operation of the Services, enforcement of agreements or policies, investigation of misuse, or another lawful purpose.

Depending on applicable law, “Sensitive Data” may include:

Restricted Data

Unless Builda expressly authorizes the applicable use through written agreement or specific product documentation, Customers and users must not use Builda to store or process information requiring specialized legal or contractual protections beyond those Builda generally provides (“Restricted Data”), including:

Customers are responsible for determining whether information they submit is regulated or sensitive and whether their collection, disclosure, use, storage, transfer, or other processing of that information is lawful.

Customers are responsible for obtaining any legally required consent for Sensitive Data contained in Customer Data.

Where Builda acts as a controller of Sensitive Data and applicable law requires consent or another specific condition before processing, Builda will comply with that requirement.

If Builda becomes aware of Restricted Data being processed contrary to this Section, Builda may restrict access to, remove, quarantine, return, delete, or otherwise address the data as permitted by applicable agreements and law.

Nothing in this Section limits any legal obligation that applies directly to Builda.

15. Customer Responsibilities

Customers are responsible for their use of Builda and the Customer Data submitted through their accounts.

Among other things, Customers are responsible for:

Customers must not instruct Builda to process Personal Data in violation of applicable law.

Where required by applicable law or an applicable agreement, Builda may provide reasonable assistance to Customers concerning privacy obligations related to Customer Data.

16. Data Security

Builda maintains administrative, technical, organizational, and physical safeguards designed to protect Personal Data against unauthorized access, acquisition, destruction, loss, alteration, misuse, and disclosure.

Security measures may vary based on factors including:

Access to Personal Data may be restricted based on role, responsibility, authorization, or legitimate business need.

However, no Internet service, software platform, security system, encryption method, transmission method, network, or storage system can be guaranteed to be completely secure.

Accordingly, Builda cannot guarantee the absolute security of Personal Data.

Customers and users are responsible for maintaining the confidentiality and security of their credentials, devices, and account access and should promptly notify Builda if they believe an account or credential has been compromised.

If Builda becomes aware of a security incident involving Personal Data, Builda will investigate the incident and take actions it determines appropriate under the circumstances, including providing legally required notices where applicable.

17. Data Retention

Builda retains Personal Data only for as long as reasonably necessary for the purposes for which the information is processed, subject to applicable legal, contractual, security, accounting, tax, fraud-prevention, dispute-resolution, and operational requirements.

Retention periods depend on the category of information, purpose of processing, sensitivity of the information, legal requirements, risks associated with the information, and whether the information is needed to establish or defend legal rights.

Account and Customer Data

Account and Customer Data is generally retained while an account remains active and as necessary to provide the Services.

When an account is deleted, Builda initiates deletion of associated Customer Data from active systems in accordance with Builda’s deletion processes.

Deletion does not necessarily cause every copy of every record to disappear instantaneously from every system.

Limited information may remain temporarily or for a legally permitted period in:

Information retained following deletion will remain subject to applicable safeguards and will be deleted, overwritten, anonymized, or otherwise disposed of under Builda’s applicable retention practices unless continued retention is permitted or required.

Payment and Transaction Information

Transaction and billing information may be retained as reasonably necessary for accounting, tax, payment administration, fraud prevention, audits, disputes, legal compliance, and financial recordkeeping.

Security and Technical Information

Security, audit, technical, and diagnostic logs may be retained for periods reasonably necessary to protect Builda, investigate incidents, prevent fraud or abuse, troubleshoot problems, maintain system integrity, and comply with law.

Support and Business Communications

Support and business communications may be retained for periods reasonably necessary to resolve requests, maintain appropriate business records, improve support, resolve disputes, and comply with legal obligations.

Marketing Information

Marketing information may be retained while Builda maintains a legitimate marketing or business purpose, subject to applicable law and your preferences.

If you unsubscribe from marketing, Builda may retain limited information necessary to maintain a suppression record and honor the request.

Cookie and Advertising Information

Cookie and related online identifiers are retained based on the purpose of the technology, applicable settings, legal requirements, and the applicable provider or technology.

When Personal Data is no longer reasonably necessary, Builda may securely delete, destroy, anonymize, aggregate, or otherwise dispose of it as permitted by law.

18. International Processing and Data Transfers

Builda is a Texas limited liability company based in the United States and makes the Services available online to users around the world.

Accordingly, Personal Data may be processed in the United States and in other countries where Builda, its service providers, subprocessors, technology providers, or other authorized recipients operate.

Privacy and data-protection laws in those countries may differ from those in your jurisdiction.

Where applicable law requires safeguards for an international transfer of Personal Data, Builda uses appropriate legally recognized safeguards.

Where applicable law permits an authorized agent to exercise rights on your behalf, Builda may require evidence that the agent is authorized and may separately verify your identity.

Builda will respond within the time required by applicable law.

If Builda denies a request and applicable law provides a right to appeal, you may appeal by emailing support@builda.community and stating that you are submitting a Privacy Appeal.

If Personal Data involved in a request is Customer Data controlled by an organization, Builda may direct you to the applicable Customer or account administrator.

During the preceding twelve months, depending on an individual’s relationship with Builda and use of the Services, Builda may have collected the following categories of Personal Information:

Builda’s use of advertising cookies, pixels, device identifiers, advertising services, analytics technologies, and similar technologies may constitute “sharing” or “sale” under California’s statutory definitions.

California residents may opt out of applicable sale or sharing through the privacy choices mechanism available on buildastg.kinsta.cloud.

Builda also recognizes qualifying opt-out preference signals, including GPC, as required by California law.

Sensitive Personal Information

Builda does not intentionally use or disclose Sensitive Personal Information that Builda controls for purposes requiring a right to limit under the CCPA unless Builda provides the applicable legally required right.

Customer submission of Sensitive Personal Information is subject to Section 14.

California Rights

Subject to applicable law and exceptions, California residents may have the right to:

You may unsubscribe from marketing emails through the unsubscribe mechanism in the communication or by contacting support@builda.community.

Even after you opt out of promotional communications, Builda may continue to send communications reasonably necessary to provide or administer the Services, including:

27. Minimum Age and Children

Builda accounts and the Services are intended for persons who are at least 18 years old.

Individuals under 18 may not create or maintain a Builda account.

Builda does not knowingly permit individuals under 18 to register as users.

If Builda learns that an individual under 18 has directly created an account or provided Personal Data in violation of this requirement, Builda may suspend or terminate the account and take reasonable steps to delete the applicable information, subject to legally permitted or required retention.

Customer Data may contain information relating to other individuals, including minors, if a Customer submits such information. Customers are responsible for ensuring that they have the legal authority to process such information through Builda and that their use complies with applicable law.

The Services are not intended to be used for processing children’s Personal Data where doing so would require Builda to undertake specialized parental-consent or child-directed-service obligations unless Builda expressly agrees to support that use.

If you believe a person under 18 has improperly created a Builda account, contact support@builda.community.

28. Third-Party Websites and Services

Builda may contain links to or provide access to third-party websites, applications, products, or services.

Except where a third party processes Personal Data solely on Builda’s behalf as a service provider, Builda does not control the third party’s independent privacy or security practices.

A third party’s availability through Builda, approval for the Builda marketplace, or integration with Builda does not constitute a warranty or guarantee regarding that third party.

Your interactions with independent third parties are governed by their applicable terms, permissions, and privacy practices.

You should review those privacy practices before providing information or authorizing access.

29. Changes to This Privacy Policy
